How Parenting Time Works

The 40% Threshold

Under Section 9 of the Federal Child Support Guidelines, when a parent has custody of the child at least 40% of the time, the set-off approach applies. This changes how child support is calculated.

Set-Off Approach

Both parents' support obligations are calculated based on their income, and the difference is paid by the parent with the larger obligation. This creates a more balanced approach in shared custody situations.

Counting Methods

Courts may count overnights (for young children) or full days (24-hour blocks) when determining percentage time. The same method should be used consistently.
